I know you will be surprised to receive this letter I am Mr. Michael Edeh of the Democratic Republic of Congo and a close associate of the late President, Laurent Kabila,of the Democratic Republic of Congo. I got your address through the Congo Information Exchange. What a bogus argument. The patents are licensed for GPL use only, and
then you blame the GPL ? Uh ?

And you're still not addressing the "what if RedHat etc. go bad?"
problem. And bringing up IBM doesn't solve the problem of patents: it
just /adds/ to the worries.

The fact is, I cannot use ideas from these patents in free software
(RedHat's or whoever's) without the risk that some day I will be sued
to hell and back. GPL/free software license or not.

The fact that these patents are much preferred to those held by
companies with agendas who won't license to GPL software, does not make
the patents OK, and frankly I'm quite surprised to hear you saying
this :(

intro to patent law and patent licensing. Look up estoppel. When a
promise not to sue for patent violation is made it has certain force.

That promise exists:

so if you are writing GPL software you only have a problem if you sue
Red Hat first.

You are assuming that legal departments hassling people is not a
problem. A simple threat, valid or not (legal or not), is enough to harm
a free software project built by volunteers. I know you know this.

Just because the patent policy calls the inconsistency "perceived"
doesn't mean it's not a real inconsistency.

I can understand Red Hat's decision, but personally I think the
assertion that such patents do not harm the free software community is
deceptive.

Since I'm not planning to infringe on these patents any time soon, and
I've made my point, I'll shut up now :)
