Its not pre-emptive. But I think some ppl (esp those who use linux for
real-time tasks) put patches to make it preemptive.

Lots of differences. The o(1) scheduler, large changes in VM, Device
driver interfaces, PCI device interfaces etc etc. Infact, as per a
slashdot article, at one point ppl toyed with the idea of making the
2.6 as 3.0 directly due to the amount of changes.
